Terms of Tutoring
SCHEDULING TIME
Appointments will begin promptly at their scheduled time regardless of the time of the Student’s arrival. No adjustment to fees will be made for time lost because of late arrival by the Student or by early termination of the session by the Student. Lessons are scheduled for 1 hour, with 5 minutes of the lesson time reserved for transition.
TEXTBOOKS
Students working on Test Preparation Programs MAY BE required to purchase a specific textbook associated with their test.
CANCELLATION NOTICE
The Student may cancel tuition by giving at least 24 hours prior notice to the Tutor in which case no tuition fees will be incurred. Lessons not attended by the Student without giving 24 hours prior notice to the Tutor shall be charged a cancellation fee of $50.
The Tutor may cancel lessons by giving 24 hours prior notice to the Student in which case no fees shall be incurred. If, under emergent circumstances, the Tutor must give fewer than 24 hours notice, the Student will be credited $25 for the inconvenience. Where a lesson was pre-paid, the Tutor shall reschedule the appointment at a mutually agreeable time, failing that, the Student will be refunded the full missed lesson fee.
FEES
Payment is due at the start of each session. Payment will be accepted via cash or check. Checks that are not honored by the bank will be subject to a $25 return check fee.
REFERRALS
Any Student who refers another student will receive a $35 credit to his or her account once the referred student has attended a tutoring session. Please note when referring that price rates may vary between students and subjects.
Legal Terms
OBLIGATION OF THE TUTOR
The Tutor undertakes to do all preparation prior to lessons and to structure lessons in such a way as to optimize time to the benefit of the Student.
With exception of a minor Student’s parent or guardian, the Tutor shall keep confidential the Student’s information. The Tutor shall contact other parties involved in the education of the student only if given verbal permission by the Student (or minor Student’s guardian) to do so.
The Tutor shall at no time be required or obligated to execute homework or assignments on behalf of the student.
OBLIGATION OF THE STUDENT
The Student shall assist the Tutor in identifying problem areas in which the student needs specific tutoring. The Test Prep Student further agrees to complete all assignments and tests between sessions in order to maximize tutoring sessions.
The Student agrees to provide his or her own materials needed for each tutoring session (e.g. books, notes, calculator, paper, other relevant study material, etc.).
NO WARRANTIES
The Tutor makes no promises or warranties with regards to the Student’s performance as a result of any tutoring provided.
TERMINATION
Either party may terminate this tutoring contract at any time by giving the other party seven days prior written notice.
RELAXATION OF TERMS
No relaxation, indulgence, waiver, or release by any party of any of the rights in the terms of this agreement on one occasion shall prevent the subsequent enforcement of such rights and shall not be deemed a waiver of any terms of this agreement on one occasion shall prevent the subsequent enforcement of such rights and shall not be deemed to be a waiver of any subsequent breach of any of the terms.
WHOLE AGREEMENT
This agreement constitutes the entire understanding between the parties with regard to the subject matter thereof and the parties waive the right to rely on any alleged expressed or implied provision not contained herein. Any alteration to this agreement must be in writing and signed by both parties.
MINORS
Where the Student is a legal minor, the Parent/Guardian shall enter into this tutoring contract on behalf of the Student and shall accept and agree to all of the terms and conditions contained herein on behalf of the Student.
